General Terms and Conditions of Sale

1. Scope of Application

These GTC apply to all orders placed on the Website by any customer (the "Customer"), whether an individual or a professional. They prevail over any other terms and conditions, unless expressly agreed otherwise in writing.

The Art Of Backgammon reserves the right to modify these GTC at any time. The applicable version is the one in force on the date of the order.

2. Products

All backgammon boards offered for sale on the Website are handcrafted pieces. Each product is unique and may present slight variations in wood grain, leather texture or finish, which are inherent to artisanal craftsmanship and do not constitute defects.

Product descriptions, photographs and specifications are provided for information purposes only and are as accurate as possible. However, slight differences may exist between the images displayed and the actual product received.

3. Prices

All prices are indicated in Euros (€) and include all taxes (VAT included) applicable on the date of the order, unless otherwise stated.

Shipping and delivery costs are additional and will be clearly indicated before the order is confirmed. The Art Of Backgammon reserves the right to modify its prices at any time, but products will be invoiced on the basis of the prices in force at the time the order is placed.

4. Orders

To place an order, the Customer must:

• Select the desired product(s) and add them to the shopping cart;
• Verify the details of the order (products, quantities, prices, delivery address);
• Confirm the order and proceed to payment.

The order is considered final once payment has been validated. An order confirmation will be sent to the Customer by email to the address provided during the order process.

The Art Of Backgammon reserves the right to refuse or cancel any order in the event of a dispute relating to a previous order, non-payment, incomplete or incorrect delivery address, or suspicion of fraud.

5. Payment

Payment is due in full at the time the order is placed. The following payment methods are accepted:

• Credit card (Visa, MasterCard, American Express);
• PayPal;
• Bank transfer (for bespoke orders or upon request).

All payments are secure. The Art Of Backgammon does not store any banking information. Payment data is processed by certified third-party payment service providers.

6. Delivery

Delivery times: Orders are generally processed and shipped within 5 to 10 business days for in-stock items. For bespoke or made-to-order products, delivery times will be communicated at the time of order and may vary from 4 to 12 weeks depending on the complexity of the piece.

Shipping methods: Products are shipped via reputable carriers (such as DHL, FedEx, UPS or La Poste) with tracking and insurance. Delivery times vary depending on the destination.

Delivery address: The Customer is responsible for providing a complete and accurate delivery address. The Art Of Backgammon cannot be held liable for delays or non-delivery resulting from an incorrect or incomplete address.

Receipt of goods: Upon delivery, the Customer must inspect the package and report any visible damage to the carrier immediately. Any damage or missing items must be reported to The Art Of Backgammon within 48 hours of receipt.

7. Right of Withdrawal

In accordance with applicable consumer protection laws, the Customer has a right of withdrawal of 14 calendar days from the date of receipt of the product, without having to provide a reason.

To exercise this right, the Customer must notify The Art Of Backgammon by email at gennay31@gmail.com before the expiry of the withdrawal period.

The product must be returned in its original condition, complete (including all accessories, packaging and documentation), and unused. Return shipping costs are the responsibility of the Customer, unless the product is defective or does not conform to the order.

Exceptions: The right of withdrawal does not apply to bespoke or personalised products made to the Customer's specifications (custom dimensions, monograms, specific materials, etc.).

Upon receipt and inspection of the returned product, The Art Of Backgammon will issue a refund within 14 days using the same payment method used for the original transaction.

8. Legal Guarantees

All products sold by The Art Of Backgammon are covered by the following legal guarantees:

Guarantee of conformity: The Customer benefits from a legal guarantee of conformity for a period of two years from delivery of the product. During this period, the Customer may request repair or replacement of the product if it does not conform to the order or presents a defect.

Guarantee against hidden defects: The Customer may also invoke the guarantee against hidden defects within two years of discovering the defect, in accordance with the applicable Civil Code.

To make a claim under these guarantees, the Customer must contact The Art Of Backgammon at gennay31@gmail.com and provide proof of purchase and photographic evidence of the defect or non-conformity.

9. Limitation of Liability

The Art Of Backgammon undertakes to provide products of the highest quality. However, our liability is limited to the replacement or refund of defective or non-conforming products, within the limits of the legal guarantees set out above.

The Art Of Backgammon cannot be held liable for:

• Damage resulting from improper use, negligence or normal wear and tear of the product;
• Delays in delivery due to force majeure, strikes, natural disasters or any other event beyond our control;
• Indirect or consequential damages (loss of profits, loss of data, etc.).

10. Intellectual Property

All content on the Website, including but not limited to texts, images, logos, designs, photographs and videos, is the exclusive property of The Art Of Backgammon and is protected by intellectual property laws.

Any reproduction, representation or use of this content, in whole or in part, without the prior written consent of The Art Of Backgammon, is strictly prohibited and may result in legal action.

11. Personal Data

The personal data collected during the order process (name, address, email, telephone number, etc.) is used solely for the purposes of processing and delivering the order, as well as for customer relationship management.

12. Dispute Resolution and Mediation

In the event of a dispute, the Customer is invited to contact The Art Of Backgammon at gennay31@gmail.com in order to seek an amicable resolution.

If no amicable solution can be found, the Customer may, in accordance with European regulations, submit the dispute to a consumer mediator. The contact details of the competent mediator are available upon request.

13. Governing Law and Jurisdiction

These GTC are governed by and construed in accordance with the laws of France.

In the event of a dispute and failing an amicable resolution or mediation, the competent courts of France shall have exclusive jurisdiction, unless mandatory legal provisions provide otherwise.
